Learn About Divorce

The decision to file for divorce is never an easy one. Whether you've decided to take the initiative to end your marriage or you've been served with divorce papers, you need to understand the divorce process, your rights, and what you can expect in the coming months. During this difficult time, it's all the more important that you keep a clear head, gather accurate information, and get advise from professionals who can help guide you through the process.

It's easy to make bad decisions during an emotional time, or to prioritize "getting it over with" at the expense of planning for the future, but the decisions you make now may impact the rest of your life. You can't afford to make emotional, uninformed choices.

Use the information on this website to learn about divorce generally, and the broad issues you may be facing. When you're ready to act, though, talk to a divorce attorney in your area before you make any decisions.

Divorce Reaches into Many Different Areas of Your Life

Of course you know that you'll have to address issues like property division, child custody, child support, and possibly alimony or spousal maintenance in your divorce case. You are probably prepared to sort out who gets the house, if you own one, and to divide your cars, bank accounts, and outstanding debts.

Even those very basic divorce issues can be complicated. You may have to hire appraisers to determine the value or your home or other assets. You may be required to consult a custody counselor or other professional before the court makes a determination on child custody and visitation. And you may have to call witnesses or provide other evidence about custody, dissipation of assets, the source of property one or both of you owns, and more.

And then there are issues you may not even have considered. What are the tax consequences of your property division or any award of alimony or maintenance? Is your spouse entitled to a share of your pension, even though you won't be retiring for many years? Is one of you going to lose your medical insurance coverage when you are no longer a legal dependent of the other?

Fortunately, You Don't Have to Answer These Questions Alone

When custody of your children, ownership of your home, and your livelihood are at stake, you can't afford to take chances or enter into the divorce process uninformed.

Still Dealing with these Issues after Divorce?

Some of the issues decided in a divorce case are largely set in stone with the final decree, except in the very unusual divorce case that is appealed. Generally, for instance, a property division isn't subject to modification except under extreme circumstances, such as when evidence comes to light that one party has concealed assets. Other issues, however, remain "open" long after the final decree is entered. For instance, custody, visitation, and child support may be modified under certain circumstances, and that possibility remains open for as long as the child or children involved are dependent minors.

If your divorce is final but you're having trouble collecting child support, or you want to petition to modify custody, to increase your visitation rights, or to alter child support based on a change in your income or your spouse's, a divorce lawyer can help.
